Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the websites, applications, and services operated by Project Lunar Inc. ("Project Lunar", "we", "us", "our"). By creating an account, purchasing a plan, or otherwise using our services, you agree to these Terms. If you do not agree, do not use the services.


1. Who We Are

Project Lunar Inc. is a company incorporated in Alberta, Canada, operated by Xander Gamelo. Contact: xander@lunar-project.com  ·  lunar-project.com.


2. Services Covered

These Terms apply to all Project Lunar services, including:

  • Marketing & creative services — strategy, campaigns, copy, design, and related professional services delivered under a separate statement of work or agreement.
  • Creative Studio / Content Factory — the self-serve and managed content generation tools (image, video, and written content) at projectlunar.ai and studio.projectlunar.ai.
  • Mission Control — the dashboard and operations interface at projectlunar.ai.
  • Lunar Dialer — the outbound calling application. The Dialer is also subject to its supplemental Terms of Service, which control in the event of any conflict for that product.

Where a signed master services agreement or statement of work exists between you and Project Lunar, that agreement controls for the services it covers; these Terms govern everything else.


3. Eligibility & Accounts

  • You must be at least 18 years old and able to form a binding contract.
  • Accounts are intended for business use. You are responsible for the accuracy of the information you provide.
  • Authentication is provided through Clerk. You are responsible for safeguarding your credentials and for all activity under your account.
  • Notify us promptly at xander@lunar-project.com of any unauthorized use.

4. Acceptable Use

You agree not to use the services to:

  • Violate any applicable law or regulation, including the Canadian Anti-Spam Legislation (CASL), the U.S. Telephone Consumer Protection Act (TCPA), and applicable Do-Not-Call rules for any outbound communication.
  • Generate or distribute any sexual content involving minors, or any content that sexualizes a minor — this is strictly prohibited, will be blocked, and may be reported to authorities.
  • Create non-consensual intimate imagery, sexual "deepfakes," or any depiction of a real, identifiable person's face, likeness, or voice without that person's consent.
  • Generate, upload, or distribute content that is unlawful, infringing, defamatory, hateful, harassing, or that promotes violence.
  • Infringe the copyright, trademark, intellectual-property, privacy, or publicity rights of others, including generating a third party's copyrighted characters or branded works.
  • Attempt to reverse engineer, disrupt, overload, or gain unauthorized access to the services or their underlying infrastructure.
  • Resell or sublicense the services except as expressly permitted in writing.

You are solely responsible for the prompts you submit, the content you generate, and how you use that content. We use automated filtering and may suspend or terminate accounts and remove content that violates this section, and we cooperate with lawful requests from authorities.


4a. Reporting & Content Takedown

To report content you believe violates these Terms — including non-consensual intimate imagery, content that depicts you without consent, or material that infringes your rights — email xander@lunar-project.com with the URL or asset details and a description of the issue.

For reports of non-consensual intimate imagery (including AI-generated "deepfakes") that depict you, we will remove the reported content, and make reasonable efforts to remove identical copies, within 48 hours of a valid report, consistent with the U.S. TAKE IT DOWN Act.

5. AI-Generated Content

Project Lunar's tools use third-party AI models to generate images, video, and text. AI output is provided on an "as-is" basis. We do not guarantee that any output is accurate, original, non-infringing, or fit for a particular purpose, and identical or similar output may be produced for other users.
  • Your responsibility. You must review AI-generated content before relying on or publishing it, and you are responsible for ensuring it is lawful and appropriate for your use.
  • Output & rights. As between you and Project Lunar, and subject to your payment of applicable fees and to the underlying AI providers' terms, we assign to you whatever rights we have in the output so you may use it under these Terms. We do not represent that AI-generated output is protected by copyright or exclusively owned by anyone. Under current U.S. Copyright Office guidance, material generated by AI without sufficient human authorship may not be copyrightable, may not be exclusive to you, and may be identical or similar to output provided to other users. You are responsible for confirming your rights before relying on any output.
  • Your inputs. You retain ownership of the prompts, brand assets, and materials you provide ("Inputs"). You grant us a limited licence to process Inputs to operate and improve the services.

6. Plans, Credits & Billing

Some services are offered free, on a credit basis, or by subscription. Payments are processed by our payment provider (Stripe). By purchasing, you authorize the applicable charges.

Credits / tokensConsumed per generation at the rates shown in-app at the time of use. Credits have no cash value and are non-transferable.
SubscriptionsBilled in advance on a recurring basis until cancelled. Cancel anytime; access continues to the end of the paid period.
Pass-through costsCertain usage-based costs (e.g. outbound call minutes via Amazon Connect, premium model usage) may be passed through to the account holder.

Except where required by law, fees and credit purchases are non-refundable. Prices may change on prospective notice. You are responsible for any applicable taxes.


7. Intellectual Property

The services, including the software, interfaces, designs, and the Project Lunar name and marks, are owned by Project Lunar Inc. and its licensors and are protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the services in accordance with these Terms — no other rights are granted.


8. Third-Party Services

The services rely on third-party providers, each governed by its own terms and privacy policy, including (without limitation):

When you generate content, you also agree to the acceptable-use and prohibited-use policies of the AI provider that fulfills your request. We are not responsible for third-party services or for outages, changes, or actions outside our reasonable control.


8a. Copyright Complaints (DMCA)

We respect intellectual-property rights and respond to notices of alleged infringement. If you believe content available through the services infringes your copyright, email our copyright contact at xander@lunar-project.com with: (1) your contact information; (2) identification of the copyrighted work; (3) identification of the allegedly infringing material and where it is located; (4) a statement of your good-faith belief that the use is not authorized; (5) a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act on the owner's behalf; and (6) your physical or electronic signature. We remove or disable access to material that is the subject of a valid notice and terminate repeat infringers in appropriate circumstances.


9. Disclaimers

The services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or that any result or output will meet your expectations.


10. Limitation of Liability

To the maximum extent permitted by law, Project Lunar Inc. and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the services will not exceed the greater of (a) the amount you paid us for the services in the three (3) months before the event giving rise to the claim, or (b) CAD $100.


11. Indemnification

You agree to indemnify and hold harmless Project Lunar Inc. and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the services, your content or Inputs, or your breach of these Terms or of any applicable law.


12. Suspension & Termination

You may stop using the services at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect the services or other users. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.


13. Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts located in Alberta, Canada for any dispute not subject to mandatory arbitration or small-claims jurisdiction.


14. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above and, where feasible, by notice through the services. Continued use after the effective date constitutes acceptance of the updated Terms.
